Below is the relevant legislation related to parity that has been introduced during the current or recently adjourned legislative session. State parity legislation passed in any state since 2008 is usually designed to increase compliance with the federal law and to strengthen state laws.

Summary

This bill tried to change the state insurance law about parity for substance use disorder coverage in the following ways:

  • Applies this section of the law to individual plans
  • Requires plans to cover residential treatment instead of making it optional with no specified annual limit for days of treatment
  • Eliminates the 60 day annual limit for inpatient care
  • Eliminates the 120 day annual limit for partial hospitalization
  • Eliminates all language about exchanging inpatient days for days of residential treatment or partial hospitalization (no longer matters because there are no more annual limits)
  • Eliminates annual limits for outpatient care

This bill also would have repealed the section of the law that allowed plans to offer optional coverage for residential treatment.

Summary

This bill tried to change the sections of the state insurance law about parity so that plans would have to cover services provided by a licensed marriage and family therapist. It also tried to change the state public welfare law so that Medicaid would cover services provided by a licensed marriage and family therapist.
